6.1 Restrictions for taking

6.1.1 What restrictions (if any) should be made on the taking of pictures of items on private property?

  1. Neither individuals nor corporate entities should be permitted to take pictures specifically of anything on private property without the property owner's permission (assuming no trespass is required).
  2. Individuals, but not corporate entities should be permitted to take pictures specifically of anything on private property without the property owner's permission.
  3. No restrictions should be placed on the taking of pictures specifically of anything on private property, visible from a public space.
  4. More debate needed.

6.1.2 What restrictions (if any) should be made on the taking of pictures of items in public?

  1. Pictures of 'sensitive' objects or people (even in public) should not be permitted (such as photographing security systems, police officers - more precise definitions to be defined later).
  2. No restrictions should be placed on the taking of pictures in public spaces.
  3. More debate needed.

6.2 Restrictions on publishing

What restrictions (if any) should be placed on the publishing (whether physically or online) of pictures?

  1. Neither individuals nor corporate entities should be permitted to publish pictures specifically of anything on private property without the property owner's permission, even if taken from public spaces.
  2. Individuals, but not corporate entities should be permitted to publish pictures specifically of anything on private property without the property owner's permission.
  3. No restrictions should be placed on the publishing of pictures specifically of anything on private property, visible from a public space.
  4. More debate needed.

6.3 Requests for removal

What options should be available for individuals concerning 'sensitive' photographs published of them or their property? It is assumed that the publishing of the specific photographs is legal. "Removed" includes distortion of the relevant part of the image to the effect that it is unrecognisable.

Individuals should have the right to insist, upon request, that any photograph (or footage)...

  1. ... of them, published or taken by a corporate entity, be removed.
  2. ... of them, published or taken by a corporate entity or another individual, be removed.
  3. ... of them in a non-public space (even if viewable from public) published or taken by a corporate entity be removed.
  4. ... of them in a non-public space (even if viewable from public) published or taken by a corporate entity or individual be removed.
  5. ... of them or their property in a non-public space (even if viewable from public) published or taken by a corporate entity be removed.
  6. ... of them or their property in a non-public space (even if viewable from public) published or taken by a corporate entity or individual be removed.
  7. ... of them or their property in private (i.e. not visible from a public space) published or taken by a corporate entity be removed.
  8. ... of them or their property in private published or taken by a corporate entity or individual be removed.
  9. Individuals should have no power to force the removal of photographs.
